These are layouts i've been doing that "closely" follow the original manufacturers layout. They are not 100% "direct copies" of the original artwork, but are very close...close enough to "pay tribute". If you're a "geek" like me, sometimes its fun to build a pedal / lay it out the way it was originally intended.

I will do the same as I acquire some vintage pedals. the DOD delay i posted in the other thread is the only "vintage" pedal i own at the moment...

I'm a little "hesitant" to do the DOD one you posted "as is", simply because its an "exact" trace...the layouts i have been doing are very close, but not exact, so as to avoid any infringement issues.

Theyre fun to do though !

You might get in trouble for that one from Philip (Fuzz Central). He has said on this forum that he designed the artwork for that board.

Nope...this was done from scratch (this morning), using the bottom side and top side photos of a 1968 FF...i'm sure if you compare it to Philips, the traces will be slightly different. Then again, its also slightly different from a Dallas board...

Not to rain on any parades here, but if a jury can be convinced that a piece of artwork was within reason derived from another piece of artwork, you're still liable. The fact that you know that your tribute artwork is very similar but just enough different to get around the law is likely to sway the jury for the plaintif if that gets brought up in a hypothetical suit.

Copyright law includes "derivative works" as something covered by an original copyright, specifically to prevent would-be infringers from changing a line here, a color there just to be different.

A reasonable defense is that you did your own work in a vacuum with no influence from the copyrighted work, and by chance got the same or very similar results. That's a hard argument to make stick if you are putting shapes on a plane as in PCB artwork. Another defense is that something is so simple and technically bound that there is only one very similar set of shapes to do it. Again, very hard to make stick with shapes on a plane.

The likelihood of getting sued is small, but lawsuits are like nuclear bombs - one is enough to ruin your whole day.

Can you get sued just for posting online? Just curious as to the specifics of infringment...I was under the impression that it had to do with using the design for commercial purposes.

You will not learn that here in any usable fashion. If you think you are about to do something that may get you into legal problems, retain an attorney of your own. As a middle step, go to the US Copyright and Patent office web site and read up on the law. If you think you might be violating someone's copyright, think several times before doing it.

How can you be sure that you're not violating copyright? Easiest thing in the world. Just write your own stuff, don't plaigarize. Draw your own artwork, don't copy others. If it comes purely out of your head, it's not an infringement. If you are doing something with someone else's stuff, it may well be infringement.

It may have at one time. In the US today, courtesy of the movie studios and music owners, it is a criminal act to infringe copyright including actions not done for commercial gain. Then there is the civil process too, which is a second, separate set of court actions that you may get to "enjoy". In particular, the Digital Millenium Copyright Act provides that under certain circumstances you may be fined up to $100,000 for a first and  non-commercial infringement.

and besides, i'm not shure about the US legal system but usually, before a company will put money into sueing you, they'll send a legal notice asking you to remove their stuff from the net and sue you only if you don't do it... so that'll give you time to relocate the said "stuff" on a server outside the united states under some other nickname   

i like the idea.  that sucks if there are still legal issues.  for one, it's just an homage.  two, these are vintage styles.  it's not like they are readily available.   besides if you were to buy one now, the company wouldn't make money off of it.  seems the people selling and making money from an actual used unit (ebayers) should be more at risk than you.  i know the legal system has to have things like this, but it still sucks since these layouts will only be used for personal purposes.

maybe "someone" should make an anonymous nickname ID on yahoo.co.uk  or  yahoo.de  or  yahoo.fr  and create an account on some european equivalent of MySpace and post "genuine" FX layouts there, then if we "happen" to find this link, well it's not our fault is it?     

I do them because i enjoy it...if a company asks me to remove the layout, i'll happily do so...till then....
