It's driving me nuts!

I just finished my Blues breaker clone, and i added the millenium 2 bypass circuit. At first the LED didn't work, it was the biasing of the MOSFET (BS170), now the LED works to much!!...it won't go off, not when bypasses and not when the effect is on...

Do you think it may be the polarity of the "low leakage diode" (wich is actually a 2n3904 without the emmiter's lead)
